Definitions and interpretation

“Apps” means any online application software that is provided by or is connected with Mundipharma (Pty) Ltd that you install or download from an online application store and access via a mobile device, including any smartphone and/or tablet device.

“We”“us”“our” and “Mundipharma” means Mundipharma (Pty) Ltd (Registration Number: 2009/020626/07) or one of its independent associated companies, where applicable.

“Websites” means the internet websites with the addresses www.mundipharma.co.zawww.betadine.co.zawww.teejel.co.za or any website with a URL that is validly registered to Mundipharma.

“You” and “your” means the user of the Sites and/or your legal guardian.

Introduction

Mundipharma respects and upholds your right to privacy. This Privacy Statement (along with our Terms and Conditions of Use) describes our practices in connection with information that we collect through activities that link to our Privacy Statement including our Websites, Apps, official social media pages or blogs that we control (collectively, the “Sites”), any customer relationship management system/s we use, SMS, and instant messaging and email messages we send and/or receive from you.

Please read this Privacy Statement carefully. By using the Sites, registering or applying online for any products or services, or contacting and interacting with Mundipharma electronically, you confirm that you accept and consent to the practices described in this Privacy Statement, without limitation or qualification. If you do not accept this Privacy Statement, you should not browse, access or use the Sites or interact with us electronically.

The collection and use of personal information

Personal information is any information that can be used to identify you. Mundipharma may collect information from you, including your personal information (such as name, e-mail, phone number, date of birth and postal address) whenever you use the Sites (or any services, facilities, tools or utilities offered by Mundipharma on the Sites) or contact or interact with Mundipharma electronically. The information collected will vary depending on your particular interaction with Mundipharma but will be limited to that information necessary to record and manage our interaction with you. In some cases the reason for collection of the information will be indicated when it is collected.

The personal data you provide to us will only be used for the purpose of supplying you with the requested services, information or other use for which you have given your consent, except where required otherwise by the law.

Some personal information collected by Mundipharma is considered ‘special’. Special personal information which Mundipharma may collect includes a person’s state of health and medical history. By providing us with this information you consent to us processing your special personal information for the purposes set out in this Privacy Statement and any collection notice provided.

We and some third party providers we work with automatically receive certain types of information whenever you visit or use the Sites. Automatic technologies and services we use may include, for example, Web server logs/IP addresses, cookies, Web beacons and third party application and content tools. This is non-personal information, which, alone, cannot be used to identify you.

Any automated data collection is used by the Sites’ software and by Mundipharma staff and agents only for system administration, customisation of the Sites to the needs of users and evaluation, research and development.

If you opt-in for particular services or communications, such as an e-newsletter, you will be able to unsubscribe at any time by following the instructions included in each communication. If you decide to unsubscribe from a service or communication, we will work to remove your information promptly, although we may require additional information before we can process your request.

Disclosure of information to third parties

We may share your personal information internally between different departments of Mundipharma and with third parties doing technological maintenance or working on our behalf to help fulfill business transactions, such as promotional, marketing and research activities. We impose obligations on any external organisations with which we share your personal information to maintain the integrity and security of that information.

We may disclose your personal information to any of the Mundipharma independent associated companies, which means any person, firm, trust, corporation or other entity or combination thereof which directly or indirectly (a) controls, (b) is controlled by, or (c) is under common control with Mundipharma. The terms “control” and “controlled” shall mean ownership of fifty percent (50%) or more, including ownership by trusts with substantially the same beneficial interests, of the voting and equity rights of such person, firm, trust, corporation or other entity or combination thereof or the power to direct the management of such person, firm, trust, corporation or other entity or combination thereof.

Your personal information may be disclosed to third parties in the event that Mundipharma sells or buys any business or assets, in which case Mundipharma may disclose your personal information to the prospective seller or buyer of such business or assets, or if Mundipharma or substantially all of its assets is acquired by a third party, in which case personal information held by us about our customers will be one of the transferred assets.

We may disclose personal information in response to a specific request by a law enforcement agency, subpoena, court order, or as required by law.

By participating in social sharing on the Sites (for example, on our social media pages), you may disclose personal information about yourself. Any information you post or disclose in this way will become public information, and may be available to visitors to the Sites and to the general public. You should be very careful when deciding to disclose your personal information, or any other information, on the Sites. You may also disclose personal information if you include third-parties in your electronic communications with us.

We will not sell or otherwise transfer the personally identifiable information you provide to us to any third parties for their own direct marketing use unless we provide clear notice to you and obtain your explicit consent for your data to be shared in this manner.

Security

Unfortunately, the electronic transmission of information is not completely secure. Although Mundipharma will do its best to protect your personal data, we cannot guarantee the security of your data transmitted to us; any transmission is at your own risk. It is your personal responsibility to ensure that the device you are using is adequately secured and protected against malicious software, such as Trojans, computer viruses and worm programs. You are aware of the fact that without adequate security measures (e.g. secure web browser configuration, up-to-date antivirus software, personal firewall software, no usage of software from dubious sources) there is a risk that the data and passwords you use to protect access to your data, could be disclosed to unauthorised third parties. Once Mundipharma has received your information, we will take all reasonable steps to maintain the security and integrity of your personal information including the use of computer access passwords, lock-up cabinets, personnel policies and firewalls.

Some of the information we collect may be transferred, stored, or processed on secure servers located in other jurisdictions, whose data protection laws may differ from those in South Africa. We will use all reasonable commercial efforts to ensure that measures equivalent to those that apply in South Africa are in place to maintain the protection of the information.

Cookies and Other Tracking Technology

We may use cookies (small text files stored in a user’s browser) or other tracking technology (such as web beacons or Google Analytics) to ensure that the Sites are well managed and to facilitate improvement of the Sites. We may use such devices from time to time to track information on our systems and identify categories of users by items such as IP addresses, domains, browser types and pages visited. Our web administrator may use the information to analyse the number of users of different areas of the Sites and to ensure that the Sites are serving as a useful and effective information source.

Cookies do not collect personal information such as the user’s name or e-mail address. Only if you voluntarily submit personally identifiable information, such as by registering or sending e-mails, can these automatic tracking technologies be used to provide further information about your use of the Sites to improve their usefulness to you. A user may reject cookies as most browsers permit individuals to decline cookies. Under certain circumstances, users may be denied access to some parts of the Sites if their browsers are set to decline cookies.

Any third party links on our Sites or set out in our electronic communications with you may also use cookies; you may receive these cookies by clicking on the link to the third party site. We do not control the collection or use of information by these third parties, and these are not subject to this Privacy Statement. You should review the third party’s privacy policy.

Mobile Apps

When you download or purchase an app, you do so through a third party mobile application online store. You may be required to register with the mobile app store and be logged on before you can download or purchase an app. When downloading an app, or using an app with online features through your mobile platform, the app provider will typically also collect certain device and app-related information.

Some apps may send push notifications, or notices of interest sent out to in the absence of a specific request, to your mobile device. In the event that the Apps use push notifications, you will be provided an opportunity to opt into receiving those push notifications. If you decline to accept push notifications, you will not receive push notifications, which means you may not receive the most current updates and features of the Apps.

Location and other information will only be collected if it is necessary for the functioning of the Apps. Your prior permission will be sought in this regard.

Access to or availability of controls may vary depending on your device.

The Sites or our electronic communications with you may contain links to other sites. Mundipharma is not responsible for the privacy policies of third party sites to which links are provided. You should check the privacy policies on these sites before providing any personal information. This Privacy Statement relates only to information contained on, or gathered via, the Sites or our electronic communications with you.

Privacy Statement for Children

We do not collect any personally identifiable information from anyone we know to be a child without the prior, verifiable consent of his or her legal representative. Such legal representative has the right, upon request, to view the information provided by the child and/or to require that it be deleted.

Mundipharma treats requests to access or change information in accordance with applicable legal requirements.

Jurisdiction and Applicable Law

This Privacy Statement is governed by the laws of South Africa, and you consent to the jurisdiction of the South African courts in respect of any dispute which may arise out of or in connection with the formation, interpretation, substance or application of this Privacy Statement.

This Privacy Statement was last updated on 28 June 2019. From time to time, we may revise this Privacy Statement. Any such changes to this Privacy Statement will be promptly communicated on this page. Continued use of the Sites and contacting and interacting with us electronically after receiving notice of a change in our Privacy Statement indicates your consent to the use of newly submitted information in accordance with the amended Mundipharma Privacy Statement.
